Ex-DIG (Prisons) manages to escape jail on bail concealing HC order
Suspended Deputy Inspector General (DIG) of Prisons Bazlur Rashid has managed to get out of jail securing ad-interim bail from the Special Judge's Court-5 of Dhaka concealing the High Court order regarding his bail.
In a letter, the Anti-Corruption Commission (ACC) on Sunday informed the High Court about it. Afterward, the High Court directed the Special Judge's Court-5 of Dhaka to send Bazlur Rashid's bail related file to it as early as possible.
Besides, the ACC was asked to file a petition to the Special Judge's Court to cancel the bail of former DIG (Prisons).
On Sunday, the ACC lawyer Khurshid Alam Khan brought the problem to the attention of a virtual High Court bench through a petition.
After holding a hearing the petition, the High Court bench comprising Justice Md Nazrul Islam Talukder and Justice Ahmed Sohel later delivered the directives.
Through the hearing, the state was represented by Deputy Attorney General AKM Amin Uddin Manik and Assistant Attorney General Mahjabin Rabbani Dipa.
On Thursday, Judge Iqbal Hossain of Dhaka Special Judge Court-5 granted bail to suspended DIG of Prisons Bazlur Rashid in a case lodged over amassing against the law wealth of around Tk3.14 crore. Receiving bail, he hurriedly got out of jail in the afternoon on that day.
Earlier on October 22 last, the same court had formally framed charges against Bazlur Rashid and set November 22 to get started on recording deposition of the prosecution witnesses.
Contacted to know about the bail of suspended DIG (Prisons) Bazlur Rashid, ACC legal professional Khurshid Alam Khan said, "DIG (Prisons) Bazlur Rashid secured bail concealing the file of High Court order. When the problem was taken to the attention, the High Court ordered the subordinate court concerned to cancel the bail. Besides, the subordinate court was ordered to provide the case documents to the High Court immediately."
Deputy Attorney General AKM Amin Uddin Manik said DIG (Prisons) Bazlur Rashid pleaded for bail to the High Court on January 29 this season. After hearing, the High Court denied him bail. But, concealing the High Court order, he pleaded for bail to the subordinate court and the judge concerned granted him bail. He got out of jail on that day. The ACC brought the problem to the attention of High Court on Sunday.
On October 20 this past year, the ACC arrested Bazlur Rashid on charge of accumulating illegal wealth after questioning both Bazlur Rashid and his wife Razzakun Nahar. Later, he was delivered to jail though court.
On August 26 this year, the ACC's investigation officer deputy director Md Nasir Uddin submitted chargesheet against DIG (Prisons) Bazlur Rashid. On September 1, Dhaka Metropolitan senior special judge KM Imrul Kayes ordered to transfer the case to the Special Judge's Court-5 of Dhaka.
According to the case statement, Bazlur Rashid bought an under-construction 2,981 square feet apartment of the 'Swapno Niloy' project of Rupayan Housing Estate 55/1 (Old) 56/57 (New) at Siddheswari Road in the administrative centre. He also paid Tk 3.08 crore as the cost of the apartment. However, he didn't show any legal way to obtain earning the total amount which he spent for buying the apartment.
Besides, Bazlur Rashid did not mention any information about the purchasing of apartment in his income tax return. The amount of money he paid didn't match with his income sources. Later, a chargesheet was submitted against him for accumulating against the law wealth worth Tk 3,14,35,902 beneath the Section 27 (1) of the ACC Act.
