Shakib may encounter jail time
Filmstar and Producer Shakib Khan will probably face jail time for violating copyright law - using elements of Dilruba Khan's song 'Pagol Mon' found in the film 'Password' produced by Shakib and working with it commercially on mobile phone internet packages without authorization.
The Bangladesh Copyright Office has given the copyright certificate to the later lyricist Ahmed Kaiser, composer Ashraf Udash and singer Dilruba Khan as the proprietors of the song.
Zafar Raja Chowdhury, registrar of the Copyright Business office, told the media that it might be a violation in Section 71 of the Copyright Work if Shakib Khan used the 'pick series' and lyrics of the melody 'Pagol Mon' in his 'Password' film without the permission of the authorized owners.
"If the allegation is proved, Section 82 of the Copyright Act provides for imprisonment of six months to 2 yrs and an excellent of Tk 50,000 to Tk 400,000," he added.
Meanwhile, Shakib Khan claimed that he took "verbal permission" from Dilruba Khan before recording the tune. However, Dilruba advised that "she did not give any permission". The author of the track Ashraf Udash as well said a similar thing.
As a way to use any registered track as copyright, there has to be a written agreement signed by the owner, says the Copyright Office, adding, "There is no legal basis for a verbal permission."
Relating to this, Shakib told the media that he talked to Dilruba Khan on the telephone during the shooting of 'Password'. Another producer Iqbal, director MalekAfsary and screenwriter Abdullah ZahirBabu had been present.
"They are witnesses, I've taken permission from Dilruba Khan for the fusion of the music 'Pagol Mon'. She started to be happy too, possibly blessed me. I hardly understand why she is nowadays refusing after so various months. What's her goal? She actually is a senior artist of the united states and is now seeking to blackmail by lying," he said.
"If Dilruba Khan will not give permission, why must i take only two lines of that song?" Shakib Khan questioned, expressing "she was happy to understand that I was employing two lines of the music. She even stated the listeners will become interested in the new song. Right now a large-level artist like her is cheating with the aid of lies."
